How to File a Small Claims Court Claim in Ontario

If someone owes you money or has caused financial loss, you may be able to file a claim in Small Claims Court. In Ontario, you can sue for up to $50,000, making it a practical option for many disputes.


Step 1: Determine If You Have a Valid Claim

Common types of cases include:

  • Unpaid invoices

  • Breach of contract

  • Property damage

  • Loan repayment disputes

You must be able to prove your claim with documents or evidence.


Step 2: Identify the Correct Defendant

Make sure you are suing the correct legal entity:

  • Individual

  • Business

  • Corporation


Errors here can delay or dismiss your case.


Step 3: Prepare the Plaintiff’s Claim

You must complete the required court form outlining:

  • What happened

  • How much you are claiming

  • Supporting details

Accuracy and clarity are critical.


Step 4: File Your Claim


You can file your claim:

  • Online

  • In person at a courthouse


Filing fees apply.


Step 5: Serve the Defendant


After filing, you must legally deliver the claim to the defendant. This is called “service.”

Step 6: Wait for a Response


The defendant has a limited time to respond. They may:

  • Ignore the claim (which may allow default judgment)


Step 7: Settlement Conference


Most cases go through a settlement conference before trial. This is an opportunity to resolve the matter early.


Step 8: Trial (if needed)


If no settlement is reached, the case proceeds to trial where a judge makes a final decision.
